Welcome to HostKit. Please read these terms carefully before using our platform to host, distribute, and monetize your content brand.
1. Introduction
These Terms of Service ("Terms") constitute a legally binding agreement between you (the "User" or "you") and HostKit, Inc. ("HostKit," "we," or "us").
By accessing, registering for, or using the HostKit platform, you agree to be bound by these Terms. If you do not agree to abide by these Terms, please do not use our services.
These Terms are effective as of May 20, 2024.
2. Account Registration and Eligibility
To use HostKit, you must create an account by providing accurate, current, and complete information. You represent and warrant that you are at least eighteen (18) years old, or the age of majority in your jurisdiction, and that you have the full legal capacity to enter into these Terms.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
- Eligibility: You must be 18+ to register.
- Business Accounts: Commercial entities must provide valid tax identification and business details.
3. Acceptable Use Policy
HostKit is a platform dedicated to the creation and distribution of legitimate media content. You agree not to use the Service for any illegal purpose or in violation of any local, state, national, or international law.
Prohibited Activities:
- Uploading malware, viruses, or harmful scripts.
- Spamming, phishing, or distributing unsolicited bulk communications.
- Content that promotes hate speech, violence, or illegal acts.
4. Intellectual Property Rights
Content Ownership: You retain all ownership rights to the content you upload, publish, or create using HostKit (your "User Content"). You grant HostKit a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute your User Content solely for the purpose of providing the Service to you.
HostKit Property: HostKit, including its logo, trademarks, software, and documentation, remain the exclusive property of HostKit and its licensors. You may not copy, modify, or distribute the HostKit software without express written permission.
5. Payment Terms, Refunds, and Plan Changes
By subscribing to a paid plan, you authorize HostKit to charge your selected payment method for the applicable fee. All fees are non-refundable unless explicitly stated otherwise.
Refund Policy: We offer a 14-day money-back guarantee for new paid subscriptions. After this period, refunds are granted only in cases of service outages or significant technical failures on our end.
Plan Changes: You may upgrade or downgrade your plan at any time. Upgrades take effect immediately; downgrades take effect at the end of your current billing cycle.
6. Limitation of Liability
IN NO EVENT SHALL HOSTKIT, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES, BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (III) ANY CONTENT OBTAINED FROM THE SERVICE; AND (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE.
7. Termination and Account Deletion
We reserve the right to suspend or terminate your account and access to the Service at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
You may terminate your account by contacting support or cancelling your subscription. Upon termination, your account and all associated data will be deleted within thirty (30) days, except for logs required by law.
8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States of America, without regard to its conflict of law provisions.
Any dispute arising under these Terms shall be resolved exclusively in the federal or state courts located in Delaware.
